California Resident Privacy Notice
CALIFORNIA RESIDENT PRIVACY NOTICE
(as of July 2023)
This California Resident Privacy Notice supplements the information and disclosures contained in our Privacy Policy. The California Consumer Privacy Act (as amended or superseded from time to time, the “CCPA”) imposes certain obligations on us and grants certain rights to California residents (“California Resident,” “you” or “your”) with regard to Personal Information. If you are a California Resident, please review the following information about your potential rights with regard to your Personal Information under the CCPA. The rights described herein are subject to exemptions and other limitations under applicable law.
Terms used herein have the meaning ascribed to them in the CCPA.
1. Notice of Collection and Use of Personal Information. For the purposes of this California Resident Privacy Notice, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household, or as otherwise defined by the CCPA.
Depending on how you interact with us, we may collect, and in the preceding 12 months, we may have collected the Personal Information listed in The Types of Information We Collect and How We Collect It section of our Privacy Policy.
We may collect and use, and in the preceding 12 months, may have collected and used Personal Information about you for the purposes described in the How We Use the Information We Collect section of our Privacy Policy.
We do not “sell” your Personal Information, meaning we do not rent, release, disclose, transfer, make available, or otherwise communicate Personal Information to another business or third party for monetary or other valuable consideration. We also do not “share” your Personal Information, meaning we do not share, rent release, disclose, disseminate, make available, transfer or otherwise communicate orally, in writing or by electronic means, or other means Personal Information to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.
We retain your Personal Information as described in the How Long Is Information Retained section of our Privacy Policy.
2. Our Use and Disclosure of Personal Information and Sensitive Personal Information. As previously indicated, we do not sell or share your Personal Information. We do not knowingly sell or share the Personal Information of California Residents under 16 years old. We may disclose, and in the preceding 12 months, may have disclosed Personal Information to the following categories of third parties for the business purposes described below:
In addition, we may disclose and in the preceding 12 months, may have disclosed Personal Information to the following categories of third parties: (i) judicial courts, regulators, or other government agents purporting to have jurisdiction over us, our subsidiaries or our affiliates, or opposing counsel and parties to litigation; and (ii) other third parties as may otherwise be permitted by law. We may disclose your Personal Information to third parties upon your request, at your direction, or with your consent.
We may also disclose your Personal Information or otherwise make it available to our service providers such as our IT and/or CRM providers, or entities that fit within other exemptions or exceptions in, or as otherwise permitted by, the CCPA.
As noted in The Types of Information We Collect and How We Collect It section of our Privacy Policy, we may collect certain special category data or sensitive personal data under certain laws. We do not currently collect “Sensitive Personal Information” (as defined under the CCPA) through our Website. However, we may collect Sensitive Personal Information from our investors and such Sensitive Personal Information shall be subject to separate notices in our subscription materials.
3. California Residents’ Rights under the CCPA. If you are a California resident, you may exercise the following rights:
a. Right to Know and Access. You may submit a verifiable request for information regarding the: (i) categories of Personal Information collected, sold, or disclosed by us; (ii) purposes for which categories of Personal Information are collected or sold by us; (iii) categories of sources from which we collect Personal Information; (iv) categories of third parties with whom we disclosed or sold Personal Information; and (v) specific pieces of Personal Information we have collected about you during the past twelve months.
b. Right to Delete. Subject to certain exceptions, you may submit a verifiable request that we delete Personal Information about you that we have collected from you.
c. Correction. You may have the right to correct inaccurate personal information that we maintain about you.
d. Limit uses and disclosure of sensitive personal information. You may have the right to limit our use or disclosure of your sensitive personal information to those authorized by the CCPA. As noted above, we currently do not collect “Sensitive Personal Information” (as defined under the CCPA) through our Website.
e. Verification. Requests for access to, correction of, or deletion of Personal Information are subject to our ability to reasonably verify your identity in light of the information requested and pursuant to relevant CCPA requirements, limitations, and regulations. We will take steps to verify your request by matching the information you provided with your rights request with the information we have in our records. When submitting your CCPA request, you must provide us with all requested information via the below toll-free number or in your email request. When submitting your request, please include your name, email address, and phone number and the CCPA right(s) you would like to exercise. We will process your request based upon the personal information in our records that is linked or reasonably linkable to the information provided in your request. In some cases, we may request additional information in order to verify your request or where necessary to process your request. If we are unable to adequately verify a request, we will notify the requestor.
f. Right to Equal Service and Price. You have the right not to receive discriminatory treatment for the exercise of your CCPA privacy rights, subject to certain limitations.
g. Shine the Light. We do not rent, sell, or share Personal Information with non-affiliated companies for their direct marketing uses as contemplated by California’s “Shine the Light” law (Civil Code § 1798.83), unless we have your permission.
h. Submit Requests. To exercise your rights under the CCPA, please either call (833) 280-9523 or send an email to [email protected]. Please be sure that your request includes your name, email address, and phone number and the CCPA right(s) you would like to exercise.
i. Authorizing an Agent. If you are acting as an authorized agent to make a rights request on behalf of a California resident, send an email to [email protected] and attach a written authorization signed by the resident. We may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.
